Повноваження суб’єктів публічного управління у сфері соціального захисту населення України

Abstract

У даній статті досліджуються питання щодо визначення системи суб’єктів публічного управління, їх повноваження стосовно реалізації державної політики України у сфері соціального захисту населення. Розкривається поняття та суть публічного управління у зазначеній сфері, а також правові основи діяльності органів державної влади у сфері соціальної політики. This article examines the issues of identifying the system of entities of public administration, their authority to implement the state policy of Ukraine in the sphere of social protection of the population. Reveals the concept and essence of public administration in this area, as well as legal bases of activity of public authorities in the sphere of social policy. It is noted that in the complex of the most important problems of development of the Ukrainian state, connected with search of ways of overcoming of the crisis phenomena in economic and social life, the significance of the decision of tasks of administrative and legal support from government authorities a reliable system of social protection of the population and its most vulnerable. Social protection refers to a set of activities carried out by state authorities in various spheres of activity aimed at ensuring the access of every member of society to social benefits, elimination of social inequality and supporting the most vulnerable members of our society. The essence of public administration of the aforementioned sectors is that the government: 1) ensures the social protection of its citizens; 2) prohibits the use of forced labour; 3) creates jobs; 4) provides training; 5) to ensure normal conditions of work, to free choice of employment, profession; 6) financially supports its citizens; 7) ensures protection against unlawful dismissal; 8) provides the right to timely payment. In the study that one of the important directions of the state policy in the sphere of social protection is the adoption of state standards and state social guarantees are established by laws and other normative-legal acts. These include: minimum wages; incomes; pension provision; the determination of the type and amount of benefits; determine the size of social payments, which provide a standard of living not below the subsistence minimum. Special body authorized on behalf of the state to implement social policy is the Ministry of social policy of Ukraine. This Ministry is a Central Executive body which activity is directed and coordinated by the Cabinet of Ministers of Ukraine and which ensures forming and implements the state policy in the sphere of labour and social policy, employment and labour migration, the employment relationship, the compulsory state social and pension insurance. Pension Fund of Ukraine is the Central Executive body which activity is directed and coordinated by the Cabinet of Ministers of Ukraine through the Minister of social policy, implements the state policy on provision of pensions and accounting of persons liable to compulsory state social insurance. The Public service concerning disabled people and veterans of Ukraine is included into system of bodies of executive power and provides implementation of state policy in the sphere of social protection of invalids, veterans of war, other persons subject to the Law of Ukraine "On status of war veterans, guarantees of their social protection", veterans of work, veterans of military service, retired military personnel or retired, victims of Nazi persecutions, children of war, victims of political repression. State inspection of Ukraine on labour issues provides implementation of state policy on matters of supervision and control over observance of labour legislation, employment of population, legislation on mandatory state social insurance against accidents at work and occupational diseases that caused disability. In the article the peculiarities of public administration in the field of social policy of Ukraine and determined that the tasks of public administration in this area are to increase the material welfare and living standards of people, ensuring population employment, guaranteeing rights at work and social protection.
