Виборчі документи й документи референдуму як предмети складів злочинів

Abstract

У статті досліджено законодавчі конструкції, якими позначаються предмети складів злочинів проти виборчих прав і свобод громадян. Визначено зміст кримінально-правових ознак виборчих документів та документів референдуму, установлення яких є важливою гарантією правильної кваліфікації злочинів. Аргументовано, що предметом складу злочину варто визнавати лише ті офіційні документи із виборчих, які можуть вплинути на результати голосування. Зроблено висновки про необхідність удосконалення законодавчої термінології, якою позначено предмет складу злочину. The article investigates the legal structures that affect the composition of crimes against the electoral rights and freedoms of citizens. The content of criminal legal features of election documents and referendum documents, the establishment of which is an important guarantee of correct qualification of crimes, is determined. It is argued that only the official election documents that may affect the results of the election should be recognized as the subject of the crime. Conclusions are made on the need to improve the legislative terminology, which identifies the subject of the crime.
