Забезпечення протидії нелегальній міграції та пов’язаними із нею злочинами

Abstract

Досліджено сучасні міграційні тенденції, які спричинені тим, що Україна не тільки є транзитною зоною на шляху міграційних потоків у напрямку країн Західної Європи, але поступово перетворюється в країну тривалого перебування нелегальних мігрантів. Обґрунтовано небезпечність такого явища, як нелегальна міграція, що вийшла за межі окремих держав і перетворилась на міжнародну проблему. Проаналізовано особливості організаційно-правових механізмів з протидії нелегальній міграції в Україні. Ukraine is one of the main subject of Eurasian migration processes due to its geopolitical location, that is why illegal migration in Ukraine, as a notion has a durable tendency for increasing. State and legal influence on migration processes in Ukraine are still incomplete, that cause increasing of migration aspects’ actions. Therefore, sociably dangerous, illegal and not enough controlled by state migration processes are copious source for various crimes (from light offences to heavy crimes, for example, foundation of international terroristic organization). These challenges require from scientists, in particular, criminologists, work on more effective and productive methodology for territorial analysis of criminality. It is essential to focus more on activation of researches in the sphere of learning levels of criminality of a particular territory, learning its peculiarities and applying the researches’ results to accurate outlined demands of practical bodies in the place of their location. Holding such practical events, as founding inside of the state conditions for preventing illegal migration (making condition for migration uncomfortable and disadvantageous); improving cooperation with EU (in particular with such agency as Frontex); giving amnesty to migrants for whom Ukraine is a destination country, simplifying the procedure of getting Ukrainian citizenship, defense and assistance for unprotected stratum of migrants. Establishment of the following above suggestions and their stable support from state can vitally influence the effectiveness in the control sphere of illegal migration.
