Історія виникнення та сучасний стан покарання у виді службових обмежень для військовослужбовців

Abstract

Висвітлено історію виникнення покарання у виді службових обмежень для військовослужбовців. Заналізовано кримінальне законодавство України, яке регламентує цей вид покарання, наведено його кримінально-правову характеристику. Досліджено стан дотримання і забезпечення прав та обовʼязків категорії громадян, які відбувають покарання у виді службових обмежень для військовослужбовців. Здійснено спробу охарактеризувати сучасний стан і тенденції розвитку означеного виду покарання в кримінальному праві України. The article deals with the history of the occurrence of punishment in the form of official restrictions for servicemen, analyzes the criminal legislation of Ukraine, which regulates this type of punishment, gives its criminal and legal characteristic, gives attention to the state of observance and ensuring rights and obligations of the category of citizens serving sentences in a kind of service restrictions for servicemen, an attempt to characterize the current state and trends of development of a certain type of punishment in the criminal law of Ukraine is made. The Criminal Code of Ukraine does not convey the notion of punishment. Taking into account the corresponding provisions of Art. 50, 52, and 58 of the Criminal Code of Ukraine, service restrictions for servicemen can be defined as applicable type of basic punishment only to non-conscripted military personnel, which provides the deduction from the financial support of the convicted person in the income of the state, the prohibition (impossibility) to increase the guilty person by position and in the military rank and non-payment of his time of military service during which he served this sentence, in the term of service for the assignment of another military rank. From this definition it follows that the content of the punishment in the form of official restrictions for servicemen is that during the term of his servicing the deduction from the amount of the financial support of the convicted, to the state income in the amount established by the court sentence, in the range from 10 to 20 percent (part. 2, Article 58 of the Criminal Code of Ukraine) is conducted. Such deduction is made monthly. It should be borne in mind that, firstly, the amount of deductions determined by the court is made from the total amount of monthly maintenance of a serviceman regardless of other deductions or property charges (alimony, etc.), that is, from the extra charged, and not from the actual received money security, and, and secondly, only from his money security. The fact is that servicemen receive not only monetary, but also material security and other payments. The structure of these types of security and benefits is determined by the relevant legal acts.
