Правове регулювання громадських ініціатив: сучасний стан та напрями розвитку

Abstract

Розкрито теоретичні підходи щодо реалізації громадських ініціатив в умовах європейської інтеграції України. Проаналізовано поняття і зміст громадських ініціатив – це дії громадян, спрямовані на конструктивну участь в управлінні справами держави з метою забезпечення суспільних інтересів. Зазначено, що будучи важливою формою активності, громадські ініціативи мають сутнісні ознаки: специфічні суб’єкти реалізації (громадяни та органи публічної влади); особливий характер суспільних відносин; спрямованість на задоволення суспільних інтересів; конструктивний характер; здійснюються на основі певних принципів (добровільність, рівність, громадська участь, результативність). Система громадських ініціатив охоплює всі прояви ініціативної активності громадян у публічно-правовій сфері: форми безпосереднього здійснення громадянами публічної влади, які реалізуються з їхньої ініціативи, форми участі громадян у здійсненні публічної влади. Ухвалення нормативно-правового акта забезпечить формування системного підходу до регулювання однієї з важливих сфер суспільних відносин у демократичній державі – участь громадян в управлінні справами держави. Theoretical approaches to the implementation of public initiatives under the conditions of European integration of Ukraine are revealed. The concept of public initiatives covers the actions of citizens aimed at the constructive participation in administrating the affairs of the state in order to ensure public interests. It is noted that public initiatives as an important form of activity have the following essential features: specifc entities (citizens and public authorities); the special nature of social relations; focus on meeting public interests; constructive character; they are carried out on the basis of certain principles (voluntariness, equality, public participation, effectiveness). The proposed conception of this category should be seen as the basis for further institutionalization of public initiatives in Ukraine. The system of public initiatives which covers all manifestations of citizens’ initiative activity in the public and legal sphere is characterized; it includes forms of direct exercise of public power by citizens, which are implemented on the initiative of citizens (referendum), and forms of participation of citizens in public administration (public law-making initiative, public hearings, public meetings, public control, etc.). The normative and legal regulation of public initiatives is outlined. The necessity of complex regulation of this sphere of social relations is grounded; it leads to the adoption of the law «On General Principles of Implementation of Public Initiatives», in which it is necessary to defne the concept of «public initiatives», its essential features, to establish a unifed legal status of the subjects, to establish general requirements for implementation of public initiatives. The adoption of such a legal act will ensure the formation of a systematic approach to the regulation of one of the important spheres of public relations in a democratic state – the participation of citizens in governing the affairs of the state.
