Короткий огляд (реферат): Монографія присвячена дослідженню проблем правого забезпечення та реалізації правового статусу суб’єктів колективно-трудових правовідносин. Визначено поняття колективно-трудових правовідносин; досліджено коло їхніх суб’єктів та окреслено законодавчі умови правосуб’єктності; узагальнено теоретичні висновки про юридичні ознаки їхнього правового статусу; охарактеризовано роботодавця, організації роботодавців (їхні об’єднання) як суб’єктів колективно-трудових правовідносин; розкрито правовий статус профспілок у цих правовідносинах; з’ясовано специфіку сучасного правого статусу колективу працівників; охарактеризовано суб’єктів, що беруть участь у вирішенні колективно-трудових спорів. Книга адресована науковцям, викладачам і студентам юридичних ЗВО, а також всім, хто цікавиться розвитком сучасного трудового права. The monography is devoted to investigation of the issues of legal securement and realization of legal status of subjects of collective labour relations. The author defines the notion of collective labour relations; determines the circle of subjects of these relations; singles out the legislative conditions of legal subjectivity. Theoretical implications on the legal features of legal status of subjects of collective labour relations are generalized. Based upon these generalizations the author characterizes the employer, organizations of employers (their associations) as the subjects of collective labour relations; finds out the legal status of trade unions in these legal relations; reveals the peculiarities of actual legal status of staff of employees; characterizes the subjects that participate in the process of collective labour disputes solution. The legal features of collective labour relations are defined. They are the following: they are the type of labour relations; they arise of close connection with the individual labour relations and are integrally related to them; they exist in a form of material, procedural and processual legal relations; they arise of objectively subjective balance and consolidation of legal interests of staff of employees and the employer on the issues related to the activity that is accomplished according to the labour contract. The author circles out the peculiarities of legal status of transnational company as an employer and the staff of its employees as the subjects of collective labour relations in Ukraine. The legal provisions defining their legal status are implemented in accordance with the principles of international private law and are contained in the legislation of Ukraine (foremost) as well as in the international local and local acts within the corporation or its department. The author argues that representativeness is a subjective specific legal capacity of participants of these relations. The arguments of the necessity of unification of the legal conditions for the determination of231 representation of the interests of employees and employers in the legal relations of social dialogue and in the resolution of collective labor disputes are given. Subjective rights (such as the permissibility of the subject's behaviour), legal obligations (as a necessity of his/her behaviour), and powers (as necessary possibility or possible necessity of committing actions) of their subjects are delimited. The author concludes that, depending on the type of subject, his legal status mainly contains subjective rights (staff of employees), legal obligations (employer) or powers (trade union organization, organization of employers, bodies that are called to resolve collective labour disputes). Each of the subjects of collective labour relations is proved to be endowed with branch, generic and subjective specific legal status. The branch legal status characterizes all the subjects of labour law and is based on the legal principles of the corresponding branch of law. The generic legal status defines the basic characteristics of all participants in collective labour relations and is based on the principles of collective labour law. Subjective specific legal status is determined by the purpose of expediency of the existence of this subject and reflects its legal position in interaction with other participants in collective labour relations. Moreover, the author clarifies the differences in the legal status of different employers as subjects of collective labour relations: legal entities and their departments; state bodies; budgetary organizations; individuals. The legal status of employers of the budget sphere, state bodies and bodies of local self-government is proved narrower in content (in comparison with others), taking into account the specifics of their activities and financing. The material liability of the employer as the necessary element of its legal status in collective labour legal relations is considered. It is proposed to legislate the duty of the employer to compensate for the damage caused to the staff of the employees as a result of failure (by the employer) of the powers specified in the collective agreement. The author justifies the necessity of consolidation in the legislation of the obligation of the body that manages the strike to compensate the232 material damage caused to the employer in the case of failure or improper performance of measures to ensure during the strike of the employer's viability, the preservation of property, observance of legality and public order, prevention of a threat to life and health people, the environment. Scientific conclusions and legislative provisions on collective bargaining as a form of social dialogue are improved. The necessity of compulsory collective bargaining is argued not only for the purpose of concluding collective agreements, but also with other issues concerning regulation of relations between employers and employees. The Law of Ukraine "On the organization of employers, their associations, rights and guarantees of their activities" is proposed to amend in order it to correspond with the Law of Ukraine "On Social Dialogue in Ukraine" concerning the powers of employers' organizations for the exchange of information, consultations, conciliation procedures and other forms of social dialogue. The effective means of supporting claims and influencing the employer in solving the collective labour disputes may be the right of trade unions to declare a warning strike or a solidarity strike. Such a strike may be conducted by a decision of the elective body of the primary trade union organization, which represents in the collective labour dispute the interests of the staff of the emploees. Arguments are put forward on the adoption of new legislative provisions that would effectively regulate the status of the staff of employees in accordance with international standards and the current state of labour legal relations. The necessity of preserving the direct (through the general meeting, by collecting signatures or by secret ballot) and representative (through the conference of the staff of the employees, by participating in the work of the bodies created by the employer, as well as through the elected body of the primary trade union organization or freely elected and authorized representatives of the staff) forms of staff of employees’ participation in the production management has been proved. The organizational, control and advisory powers of the National Mediation and Reconciliation Service are differentiated. Arguments in favour of strengthening control powers and increasing responsibility for233 non-fulfilment of its decisions are presented. The necessity of consolidation in the Law of Ukraine "On the Procedure for Settlement of Collective Labour Disputes (Conflicts)" and the Regulation on the National Mediation and Reconciliation Service of the recommendation powers of the conciliatory body has been substantiated.
