Консульські установи як учасники українського нотаріального процесу

Abstract

Досліджено актуальні питання правового регулювання провадження нотаріальної діяльності органами квазінотаріату в Україні. Виконання нотаріальних дій консульськими установами України завжди сприяло захисту прав та законних інтересів фізичних та юридичних осіб України, які звертаються за вчиненням нотаріальних дій за межами держави. У статті розглянуто особливості провадження нотаріального процесу консульськими установами України. Автор пропонує доповнити частину третю статті 1247 Цивільного кодексу України таким реченням: “Посвідчення заповітів за кордоном покладається на консульські установи України, а у випадках, передбачених чинним законодавством, – на дипломатичні представництва України”. The research is devoted to the actual issues of legal regulation of the performance of notarial activities by the bodies of quasinotoriatry in Ukraine. The commission of notarial acts by consular establishments of Ukraine has always served to protect the rights and legitimate interests of individuals and legal entities of Ukraine, who are applying for notarial acts outside the state. The article deals with the peculiarities of the implementation of the notarial process by the consular institutions of Ukraine. The author proposes to add the third part of Article 1247 of the Civil Code of Ukraine to the following sentence:“The certificate of wills abroad rests with the consular offices of Ukraine, and in cases stipulated by the current legislation, to the diplomatic missions of Ukraine”.
