Адміністративне судочинство як форма здійснення судової влади

Abstract

У статті розглядаються теоретичні підходи до визначення адміністративного судочинства як форми здійснення судової влади. На підставі порівняльно-правового аналізу положень адміністративного процесуального, цивільного процесуального та господарського процесуального права виділяються ознаки адміністративного судочинства щодо захисту прав і свобод громадян, дається його визначення у контексті теоретичних положень адміністративного процесуального права на підставі визначення цілі, завдань, функцій. The article deals with the theoretical approaches to the definition of administrative legal proceedings as a form of judicial administration. Based on the comparative legal analysis of the provisions of the administrative procedural, civil procedural and economic procedural law, signs of administrative legal proceedings are given out in relation to the protection of the rights and freedoms of citizens, given its definition in the context of the theoretical provisions of administrative procedural law on the basis of the definition of purpose, tasks, functions.
