Актуальні питання гармонізації трудового законодавства в умовах євроінтеграції

Abstract

У статті досліджено актуальні питання гармонізації трудового законодавства в умовах євроінтеграції. Зазначено, що євроінтеграційні процеси, необхідність підвищення рівня захисту прав громадян, реалії часу та стрімкість цих перетворень у суспільному житті викликають потребу в продовженні реформування національного трудового законодавства. Наголошено, що гармонізація, або зближення, національного права розуміється як введення загальних засад правового регулювання в конкретних галузях суспільного життя при збереженні за державами більшого або меншого простору для власного правового регулювання. Зроблено висновок, що формування європейського простору в економічній сфері неможливе без становлення єдиного правового простору й у сфері праці. Гармонізація трудового законодавства країн ЄС та країн-кандидатів здатна створити міцну юридичну основу для поглиблення партнерства і переростання його в стабільне й ефективне співробітництво, що спирається на спільний ринок праці між учасниками цього союзу. The article examines the current issues of harmonization of labor legislation in the context of eurointegration. It is noted that the eurointegration processes, the need to increase the protection of rights, the present challenges and the rapidity of changes in public life call for further reforming national labor legislation. The development of an effective legal model for the realization of the right to work and the adaptation of national labor legislation to the legislation of the European Union requires the joint efforts of, first of all, experts in labor law and social security law and the application of theoretically substantiated, reasoned approaches towards it. As for Ukraine, the realization of the right to work in the context of Ukraine’s eurointegration should be perceived as an instrument for and the process of fulfilling our state’s strategic goals and objectives of national, national economical, socio-political and cultural development, which has become indispensable today. It is emphasized that harmonization, or convergence is understood as introducing general principles of legal regulation in particular areas of public life while preserving the states more or less space for their own legal regulation. Harmonization as a more flexible method of legal integration is based on the convergence of domestic law with a legislative model, which allows for taking national characteristics into account. At the same time, harmonization does not intend to uniform labor legislation of the EU countries, on the contrary, it is based on the convergence of the legislation of these countries. It is concluded that the formation of the European area in the economic sphere is impossible without the formation of a single legal area in the field of labor. Harmonization of labor legislation of the EU and candidate countries can create a solid legal basis for deepening the partnership and turning it into a stable and effective cooperation based on a common labor market between the members of this union.
