Administrative and legal mechanism of information security in Ukraine (Scopus)

Abstract

Особливість організаційно-правового забезпечення адміністративно-правового режиму інформаційної безпеки зумовлює застосування технічних стандартів захисту інформації, прийнятих в ЄС та НАТО, які сформульовані в результаті виявлення типових юридичних справ та уніфікації техніко-правових норм регулюючи порядок діяльності суб'єктів інформаційної безпеки в контексті відносин, що виникають внаслідок адміністративних та інших публічних правовідносин, з метою зосередження положень на єдиності процедури усунення загроз в інформаційно-телекомунікаційних системах, у національному інформаційному просторі, що трактується як особливий спосіб юрисдикційного усунення суперечностей, що виникають у процесі людської діяльності та суб'єктів господарювання господарської діяльності в інформаційній сфері. Структура та характер адміністративно-правового режиму забезпечення інформаційної безпеки досі розглядається як система правових обмежень приватних інтересів підприємств та організацій, що надають інформаційні послуги на користь суспільних інтересів. Докази з практики показують недоліки існуючої моделі як основи правової моделі регулювання інформаційної безпеки, яка вимагає побудови нової парадигми адміністративно-правового управління на основі відкритої моделі правового управління. The peculiarity of the organizational and legal support of the administrative and legal regime of information security determines the application of technical information security standards adopted in the EU and NATO, which are formulated as a result of identifying typical legal cases and unification of technical and legal norms governing the procedure for the activities of information security entities in the context of relations arising from administrative and other public legal relations in order to focus the provisions on the uniformity of the procedure for eliminating threats in information and telecommunication systems, in the national information space, which is interpreted as a special way of jurisdictional elimination of contradictions arising in the course of human activity and business entities of economic activity in the information sphere. The structure and nature of the administrative and legal regime for ensuring information security is still considered as a system of legal restrictions on the private interests of enterprises and organizations providing information services in favor of the public interest. The evidence from practice shows the shortcomings of the existing model as a basis for the legal model of information security regulation, which requires the construction of a new paradigm of administrative and legal management based on an open model of legal management.
