Організація державної системи надання безоплатної правової допомоги

Abstract

У статті розглядаються питання організації державної системи надання безоплатної правової допомоги. Зазначено, що до учасників державної системи надання безоплатної правової допомоги відносяться органи виконавчої влади, які не тільки вирішують організаційно-правової завдання у цій сфері суспільних відносин, реалізуючи різноманітні форми та методи діяльності, а й надають безоплатну допомогу. Здійснено аналіз правових актів, які утворюють систему надання безоплатної правової допомоги. Розглянуто організацію роботи юридичних клінік вищих навчальних закладів як учасників недержавної системи надання безоплатної правової допомоги. Large-scale transformations in the country are related to the implementation of the Association Agreement between Ukraine, on the one hand, and the European Union, the European Atomic Energy Community and their Member States, on the other hand, necessitated the development of free legal aid. New public relations have emerged related to the provision of free legal aid to citizens. These relationships affect a certain part of society, which includes not only citizens who seek help, but also entities involved in the direct provision, organization of this activity. Participants in the state system of free legal aid include executive bodies that not only solve organizational and legal problems in this area of public relations, implementing various forms and methods of activity, but also provide assistance. The article considers the organization of the state system of free legal aid. The analysis of legal acts that form the system of free legal aid is carried out. The organization of work of legal clinics of higher educational institutions as participants of the non-governmental system of providing free legal aid is considered. One of the important groups of participants in the provision of free legal aid to citizens are law clinics of law schools. In addition to the participants provided by the Law of Ukraine «On Free Legal Aid», the state system of free legal aid is proposed to include legal clinics of universities that wished to enter the state system and confirmed the qualifications of heads of advisory groups, and socially oriented civil society institutions that wished to enter the state system. confirmed the qualifications of legal aid providers. It is advisable to amend the Law of Ukraine «On Free Legal Aid» in terms of the participation of lawyers in providing legal aid without a competition.
