Інтенціональний аналіз правового буття: автореферат

Abstract

Дисертація є першим в українській правовій науці вивченням філософсько-правових засад інтенціонального аналізу правового буття. У контексті поставлених у дисертаційній роботі задач установлено, що феноменологічний підхід дає підстави розуміти право як інтенційний корелят суспільної дійсності, що опредметнюється через акти правосвідомості, які виникають із потреб регулювання й організації «життєвого світу» суспільства в його відношенні до системи влади і державного управління. Окрім того, обґрунтовано, що інтенційний корелят виступає структурним елементом правосвідомості, яка виникає на рівні міжсуб’єктних відносин і здійснюється через генерування сенсів, уявлень, концептів і правових норм, обумовлюваним визнанням цінності індивідуальної й політичної свободи. Доведено, що інтенціональність проявляє таку спрямованість правосвідомості, яка містить потреби аксіологічного регулювання системи організації життєвого світу довкола ідей свободи, рівності та справедливості: це те, про що міркує чи передає у повідомленні (репрезентації) суб’єкт права.The dissertation is the first in Ukrainian legal science studying the philosophical and legal bases of the intentional analysis of the legal existence. Indeed, in the context of the objectives of the thesis, it is found that the phenomenological approach gives reason to understand the law as intentional correlate of social reality, which is materialized through acts of justice that arise from the needs of management and organization of "life-world" society in its relation to the system of power and government. Moreover, it proved that correlate intentional serves a structural element of justice that occurs at the level of between subjects relations and through the generation of meanings, ideas, concepts and rules of law, attached as recognition of the value of individual and political freedom. Furthermore it is proved that such orientation takes intentionality of justice, which contains requirements axiological control system of the organization of the life of the world around the ideas of freedom, equality and justice: it is something that talks or sends a message (representation) legal entity. In the course of the study improved: the interpretation of the prospects of the theoretical and methodological principles of phenomenology for the development of an integrative understanding of law; understanding that the basis of the phenomenological study of the legal acts being the ratio between its semantic and symbolic expression to the sense of justice and its institutional and substantive implementation. Perception phenomenological structure due to the legal sense of justice being done, which is aimed at the discovery of "pure knowledge", which differs from the theoretical. Philosophical and legal interpretation problems of law aimed at forming the image of legal existence, is a fragment of the social picture of the world and also one of the conditions completeness social cognition. Proposed in the thesis intentional concept of legal existence can extend the range of phenomena of social life, traditionally included in the substantive limits of philosophy of law, the right to identify the relationship with other phenomena of social life associated with mental activity of man and his self-awareness. The problem of intentionality legal existence belongs to a Ukrainian was processed jurisprudential space. On the one hand, in the scientific literature outlined recognized performance problems, and the other – in the available studies no phenomenological complex application procedures and regulatory factors holistic descriptions legal. Legal nature are independent of the real subject-factuality and could exist by themselves, but activity that is the basis of the constitution requires empirical or experiential material. The phenomenological approach gives reason to understand the law as the intentional correlate of social reality, through acts of justice objectivity provided arising from the requirements of regulation and organization of "life-world" society in its relation to the system of governance and public administration. The main intentional direction of justice itself is not so much force punitive function as regulatory settings to ensure systematic and organized social relations that are designed to ensure a person as its private and political freedom and social justice. So justice is always concerns idea of regulating relations between the individual, community and government. From theoretical considerations on legal socialization of the individual, mastering a certain amount of legal knowledge, legal norms, principles and requirements, legal learns these values so that they turn into personal beliefs and intentions, are vital requirement. Obviously, legal socialization must directly relate to the legal setting and, therefore, legal consciousness. Traced interdependence, harmonious combination of legal socialization emerging legal unit, and legal awareness in general. What qualitative relationship between these categories, the more real the tasks related to establishment of the rule of law, with productive legal system and stricter regulation of social relations
