Кваліфікація злочинів, передбачених різними статтями КК України

Abstract

У цій статті аналізуються положення кваліфікації злочинів, передбачених різними статтями КК України. У процесі розгляду цих положень з’ясовано, що складнощі при кваліфікації злочинів, передбачених різними статтями КК України, виникають у випадках вчинення одним діянням двох злочинів. На вирішення цих питань запропоновано окремі правила кваліфікації злочинів, передбачених різними статтями КК України. In this article positions of qualifcation of crimes foreseen are analysed by the different articles of KK of Ukraine. It is found out in the process of consideration of these positions, that complications during qualifcation of crimes foreseen arise up the different articles of KK of Ukraine in the cases of feasance of two crimes one act. On the decision of these questions the separate rules of qualifcation of crimes foreseen are offered by the different articles of KK of Ukraine.
