Застосування заходів забезпечення провадження у справах про адміністративні правопорушення

Abstract

У статті розглянуто один із видів адміністративного примусу – заходи забезпечення провадження у справах про адміністративні правопорушення. Проаналізовано думки науковців стосовно розуміння поняття «заходи забезпечення провадження» та його складових частин. Охарактеризовано зміст структурних елементів заходів забезпечення провадження, правову регламентацію та процесуальний порядок їх застосування. Вказано на співвідношення застосування таких заходів із потребою дотримання прав і свобод людини та громадянина. Обґрунтовано важливість розмежування заходів забезпечення провадження в адміністративному процесі зі схожими заходами у кримінальному провадженні. The article considers one of the types of administrative enforcement – administrative proceeding support operations. The article provides the analysis of the scientists’ opinions as to the understanding of the notion «proceeding support operations» and its components. The article characterizes the content of structural elements of proceeding support operations, legal regulation and procedural order of their implementation. The article indicates the correlation of these operations implementation with the necessity of following human and civil rights and liberties. The article provides the grounding of the importance of delineation of administrative proceeding support operations and the similar operations in the criminal proceeding.
