Ensuring implementation of the constitutional principle of gender equality in Ukraine: problems and prospects

Abstract

Утвердження та забезпечення принципу гендерної рівності прав – один із основних стандартів і водночас важливий показник демократичного поступу до втілення всезагальної рівності в діяльності провідних міжнародних організацій. Втілення рівності прав та можливостей жінок і чоловіків проголошено ключовим напрямком політики в діяльності Європейського Союзу, який почав активно розвиватись в європейських країнах розвинутої демократії ще у 80-х рр. ХХ ст. Мета наукової статті полягає у комплексному аналізі правових основ гендерної політики та конституційного закріплення принципу гендерної рівності в Україні, визначенні проблем рівності прав чоловіків і жінок в нашій державі та пошуку шляхів їх вирішення. Гендерна рівність розглядається як фундаментальна правова цінність, надбання цивілізованого розвитку держави та суспільства, адже визнання основних прав і свобод людини, ключових засад гендерної демократії є необхідною складовою становлення та розвитку сучасної правової держави, що народжується на фундаменті утвердженої ліберальної демократії. В такий спосіб відбувається процес закріплення гендерної рівності в усіх сферах суспільного життя. Дослідження тематики втілення принципу гендерної рівності в Українській державі потребує вивчення світових тенденцій рівності статей, які задекларовані в міжнародних документах, аналізу національних державних механізмів забезпечення рівних прав і можливостей жінок і чоловіків у різних країнах та регіонах світу, визначення форм гендерної демократії та формування гендерної політики і культури сучасності, з’ясування ефективної гендерної складової в публічній політиці європейських країн, діяльності політичних партій, громадських об’єднань, міжнародних організацій тощо. Гендерна рівність передбачає рівні права, свободи та обов’язки для жінок і чоловіків, їх однакову значимість у суспільстві, можливості, участь у всіх сферах суспільного життя та міжособистісних відносин. У відповідності до цього, вона також означає рівний доступ жінок і чоловіків до різних благ, ресурсів та їх розподілу між представниками обох статей. Зміна гендерного стереотипу в суспільстві визнається пріоритетом кожної держави, адже недостатньо змінити лише законодавство, підписати та ратифікувати міжнародні документи, потрібно бажання людей змінюватись самим і змінювати країну, запроваджуючи нові стандарти, застосовуючи досвід міжнародної спільноти та зарубіжних країн, які в цій сфері мають позитивний багаторічний досвід. Abstract. Approving and ensuring the principle of gender equality of rights is one of the main standards and at the same time an important indicator of democratic progress towards the implementation of universal equality in the activities of leading international organizations. The realization of equal rights and opportunities for women and men has been declared a key direction of policy in the activities of the European Union, which began to actively develop in the European countries of developed democracies in the 80s of the 20th century. The purpose of the scientific article is a comprehensive analysis of the legal foundations of gender policy and the constitutional consolidation of the principle of gender equality in Ukraine, identification of problems of equality of rights between men and women in our country and finding ways to solve them. Gender equality is considered as a fundamental legal value, an asset of the civilized development of the state and society, because the recognition of basic human rights and freedoms, the key principles of gender democracy is a necessary component of the formation and development of a modern legal state, which is born on the foundation of an established liberal democracy. In this way, the process of consolidating gender equality in all spheres of social life takes place. The study of the implementation of the principle of gender equality in the Ukrainian state requires the study of global trends in gender equality, which are declared in international documents, the analysis of national state mechanisms for ensuring equal rights and opportunities for women and men in various countries and regions of the world, the definition of forms of gender democracy and the formation of gender policy and modern culture, clarification of the effective gender component in the public policy of European countries, activities of political parties, public associations, international organizations, etc. Gender equality implies equal rights, freedoms and responsibilities for women and men, their equal importance in society, opportunities, participation in all spheres of public life and interpersonal relations. Correspondingly, it also means equal access of women and men to various benefits, resources and their distribution between representatives of both sexes. Changing the gender stereotype in society is recognized as a priority of every state, because it is not enough to only change legislation, sign and ratify international documents, you need the desire of people to change themselves and change the country, introducing new standards, applying the experience of the international community and foreign countries that have a positive long-term track record in this field experience.
