Державна політика запобігання та протидії економічній злочинності в системі гарантування економічної безпеки України: реферат

Abstract

Дисертаційна робота присвячена вирішенню наукової проблеми – обґрунтування теоретичних і методологічних положень формування та реалізації державної політики запобігання та протидії економічній злочинності в системі гарантування економічної безпеки України. Запропоновано тлумачення поняття «економічні злочини», враховуючи різноплановість підходів до розуміння змісту економічної злочинності та специфіку наукових досліджень з позиції вивчення економічних злочинів як загрози економічній безпеці держави. Здійснений бібліометричний аналіз наукових публікацій дав можливість визначити питання, які залишились поза увагою, потребують дослідження та розробки теоретичних положень та методологічного інструментарію з питання протидії економічній злочинності задля забезпечення економічної безпеки України, що сприяє розширенню теоретичних знань про економічну злочинність як об’єкт економічного дослідження. Розроблено інформаційну модель структурування наслідків економічної злочинності. Обґрунтовано склад та зміст репутаційних наслідків економічної злочинності та їх вплив на систему гарантування економічної безпеки держави. Розроблено методологічні положення формування та реалізації державної політики запобігання та протидії економічній злочинності в системі гарантування економічної безпеки держави. Виділено симптоми проблеми гарантування економічної безпеки, що є важливою складовою методології формування та реалізації державної політики і дозволить вирішити проблему в комплексі як в межах реалізації заходів із запобігання та протидії економічній злочинності, так і в межах реалізації інших видів державної політики. Виявлено системні проблеми державної політики запобігання та протидії економічній злочинності, які мають стати ключовим фактором формування завдань державної політики запобігання та протидії економічній злочинності, що дасть змогу підвищити рівень економічної безпеки держави. Проведений аналіз економічної злочинності дав можливість зробити висновок, що вона негативно впливає на рівень економічної безпеки держави, відповідно виникає необхідність здійснення нормативних та організаційних напрацювань щодо напрямів усунення таких злочинів або ж принаймні їх мінімізації. Проведене дослідження дало можливість ідентифікувати сукупність політико-правових та соціально-економічних наслідків економічної злочинності крізь призму впливу на показники, які характеризують місце країни в світових рейтингах. Обґрунтовано напрями трансформації центральних органів виконавчої влади, яка визначена в контексті запропонованих напрямів та об’єктів державної політики запобігання та протидії економічній злочинності в системі гарантування економічної безпеки. Запропоновано групувати органи центральної виконавчої влади, що реалізують державну політику запобігання та протидії економічній злочинності, що забезпечить кваліфіковане виконання функцій відповідними органами та їх структурними підрозділами та покращить координацію між суб’єктами державної політики і сприятиме її системності. Розроблено механізм міжнародної співпраці суб’єктів правоохоронної системи із міжнародними поліцейськими організаціями та правоохоронними органами зарубіжних країн і напрями взаємодії щодо запобігання та протидії економічній злочинності, реалізація яких спрямована на протидію та запобігання економічній злочинності, тероризму і розвитку цифрового суспільства з огляду на актуальність забезпечення інформаційної безпеки економічних відносин. Удосконалено механізм забезпечення інформаційної безпеки процесів запобігання та протидії економічній злочинності, що охоплює: вихідні положення, порядок забезпечення інформаційної безпеки, що включає сукупність вимог до процесів запобігання та протидії економічній злочинності та види забезпечення системи інформаційного захисту. The dissertation work is devoted to the solution of the scientific issue – the substantiation of the theoretical and methodological provisions of the formation and implementation of the state policy of prevention and counteraction of economic crime in the system of guaranteeing the economic security of Ukraine. The objectivity of the existence of each approach is substantiated, taking into account the specificity of scientific research from the standpoint of studying economic crimes as a threat to the state's economic security. Therefore, the following interpretation is proposed: economic crimes are threats to the economic security of the state, consisting in the implementation of illegal economic activities (economic processes, relations, operations) or violation of requirements for legal, economic activity to satisfy the selfish interests of a person or a group of persons. Issues that have been left out of attention and require research and development of theoretical provisions and methodological tools on the issue of combating economic crime to ensure the economic security of Ukraine have been identified. The bibliometric analysis of scientific publications made it possible to identify modern trends and trends in publications, which makes it possible to expand theoretical knowledge about economic crime as an object of economic research. An information model for structuring the consequences of economic crime has been developed. The composition and content of the reputational consequences of economic crimes affecting the system of guaranteeing the state’s economic security were substantiated. Methodological regulations for the formation and implementation of the state policy of prevention and counteraction of economic crime in the system of guaranteeing the state's economic security have been developed. Such an assessment should be based on resolving symptoms of the problem identified in previous studies. The symptoms of the problem of guaranteeing economic security are highlighted, which is an essential component of the methodology for the formation and implementation of state policy, which will allow solving the problem in a complex way both within the framework of the implementation of measures to prevent and combat economic crime and within the framework of the implementation of other types of state policy (security, social, economic, international, law enforcement). The systemic problems of the state policy of preventing and combating economic crime have been identified, which should become a critical factor in shaping the tasks of the state policy of preventing and combating economic crime, which will allow for increasing the state's economic security level. The conducted analysis of economic crimes made it possible to conclude that it affects the level of state’s economic security, accordingly, there is a need to carry out regulatory and organizational measures to eliminate such crimes or at least reduce them. The conducted research made it possible to identify a set of political, legal and socio-economic consequences of economic crimes through the prism of their influence on indicators that characterize the state's place in world rankings. A study was conducted to assess the socio-economic consequences of economic crime through the prism of the impact on the indicators characterizing the country's place in the world rankings, including public debt, competitiveness index, quality of life index, and Gini index. The latter made it possible to identify a set of socio-economic consequences of economic crime. The directions of transformation of the central bodies of executive power are substantiated. The transformation of their activities is determined in the context of the proposed directions and objects of the state policy of preventing and countering economic crime in the system of guaranteeing economic security. It is proposed to group the bodies of the central executive power that implement the state policy of preventing and combating economic crime as follows: bodies of the central executive power that directly implement the state policy in the field of preventing and combating economic crime; bodies of the central executive power, which are regulators of economic activity; bodies of the central executive power, implementing state policy in areas that form the implementation of state policy on the prevention and counteraction of economic crime. A mechanism for international cooperation of law enforcement entities with international police organizations and law enforcement agencies of foreign countries has been developed in the context of 1) justification of communication channels; 2) determination of areas of cooperation; 3) development of forms of organization of interaction in the process of combating economic crimes; 4) formation of personnel requirements for liaison officers; 5) directions of cooperation with law enforcement agencies of foreign countries in the context of prevention of economic crime, training and retraining of personnel, implementation of joint operations. The mechanism for ensuring information security in the processes of preventing and countering economic crime has been improved, which provides for initial provisions (objects of information security and cyber protection; subjects of ensuring information security at various levels of implementation of state policy; the purpose and tasks of the mechanism); the procedure for ensuring information security, which includes a set of requirements for the processes of preventing and countering economic crime and types of ensuring the information protection system.
