До проблеми захисту дітей, що потерпіли від домашнього насильства

Abstract

У статті звертається увага, що проблема домашнього насильства не нова, вона існувала ще з початку зародження людства, з початку зародження громад і понять сімейних звичаїв. Але те, що сьогодні деякі країни навчилися адекватно боротися із цією проблемою, а деякі поки просто мовчать про неї, не означає, що проблеми не існує взагалі. Ухвалення у 2018 році нового Закону України «Про запобігання та протидію домашньому насильству» є вагомою зміною в кращий бік, але, щоб він працював на повну, треба докласти багато зусиль усього населення країни. І це так, адже все населення країни, від малого до старшого, має працювати в потрібному напрямі, щоб ця проблема не була такою нагальною й глобальною. Згідно з новим Законом, «домашнім насильством» уважаються всі акти фізичного, сексуального, психологічного або економічного насильства, учинені між колишнім чи теперішнім подружжям або людьми, які разом живуть чи жили. The problem of domestic violence is not new, it has existed since the beginning of humanity, since the beginning of communities and concepts of family customs. But the fact that today some countries have learned to adequately deal with this problem, and some are simply silent about it, does not mean that the problem does not exist at all. The adoption of the new Law of Ukraine "On Prevention and Combating Domestic Violence" in 2018 is a significant change for the better, but in order for it to work to its full potential, a lot of effort must be made by the entire population of the country. And it is so, because the entire population of the country, from young to old, should work in the right direction so that this problem is not so urgent and global. According to the new Law, "domestic violence" is considered to be all acts of physical, sexual, psychological or economic violence committed between former or current spouses or people who live or have lived together. The law stipulates that the party who committed the violence will be prohibited from calling and writing with the victim, approaching him at a certain distance. If earlier domestic violence was considered to be incidents between spouses, now the circle of persons is expanding. It now includes ex-husband/wife, civil marriages (cohabitation without registration). Protecting the rights and ensuring the interests of the child is the basic principle on which the activities of the relevant state authorities, state and non-state institutions and institutions (including educational and medical) of Ukraine should be based. At the same time, violence and abuse of children is a common phenomenon. Children are most often abused by their peers, but one in four children who have experienced violence and bullying have experienced it in their own family. However, despite a relatively orderly legal framework, the results of scientific research and analysis of practice on overcoming the consequences of family violence against children prove that cruelty and violence continue to spread. The norms of the current Ukrainian legislation do not yet fully provide for a coherent and effective mechanism for effectively ensuring the rights and interests of the child, which, unfortunately, are violated daily.
