Захист прав дітей та забезпечення їх безпеки за умов воєнних злочинів, геноциду, агресії та злочинів проти людяності

Abstract

У даній публікації зроблено спробу відобразити стан справ із злочинами щодо дітей, за умов повномасштабного вторгнення Росії на українську територію, та означити можливі шляхи притягнення до відповідальності за вчинення злочинів щодо дітей з огляду наявної загальної ситуації. Захист прав дітей та забезпечення їх безпеки за умов воєнних злочинів, геноциду, агресії та злочинів проти людяності вимагають спільних, із закордонними партнерами та міжнародними інституціями, рішень, кроків та негайних узгоджених дій. Акцентовано увагу на важливості співпраці із Міжнародним кримінальним судом, зі спільною слідчою групою (JIT), і з Євроюстом. Підтримано позицію, що варто працювати, як незалежно, де це можливо, та в рамках чинного національного кримінального та кримінального процесуального законодавства, так і співпрацювати, проводити спільні розслідування щоб докопатися до істини. Продовжено узагальнення щодо наявних звернень України до міжнародних судів та наведено наявні позиції перспектив створення Міжнародного трибуналу ad hoc. Аргументовано, що досі практично не вирішеним залишається питання повернення додому примусово депортованих українських дітей. Доведено, що за наявних реалій різностороння допомога та підтримка міжнародної спільноти, у тому числі і при документуванні означених та інших кримінальних правопорушень, є неоціненною. Стратегія України, що направлена на роботу по збору доказів злочинів Росії триває. Констатовано, що ціла низка заходів України самостійно та у співпраці із закордонними партнерами та міжнародними інституціями направлені на захист прав дітей та забезпечення їх безпеки за умов воєнних злочинів, агресії та злочинів проти людяності. При цьому, завдань та викликів теж ще ціла низка. In this publication, an attempt has been made to reflect the state of affairs with crimes against children, under the conditions of a full-scale invasion of Russia on Ukrainian territory, and to identify possible ways of prosecution for committing crimes against children in view of the current general situation. Protection of children's rights and ensuring their safety under the conditions of war crimes, genocide, aggression and crimes against humanity require joint decisions, steps and immediate concerted actions with foreign partners and international institutions. Attention was focused on the importance of cooperation with the International Criminal Court, with the joint investigative team (JIT), and with Eurojust. The position was supported that it is worth working both independently, where possible, and within the framework of current national criminal and criminal procedural legislation, as well as cooperating, conducting joint investigations in order to get to the truth. The generalization of Ukraine's existing appeals to international courts is continued, and the existing positions on the prospects for the creation of an International ad hoc tribunal are given. It is argued that the issue of the return home of forcibly deported Ukrainian children remains practically unresolved. It has been proven that under the existing realities, the multifaceted help and support of the international community, including when documenting the specified and other criminal offenses, is invaluable. Ukraine's strategy aimed at gathering evidence of Russian crimes continues. It was established that a whole series of measures of Ukraine independently and in cooperation with foreign partners and international institutions are aimed at protecting the rights of children and ensuring their safety under the conditions of war crimes, aggression and crimes against humanity. At the same time, there are also a number of tasks and challenges.
