Принципи цифрової трансформації України крізь призму досвіду Європейського Союзу

Abstract

У статті розглянуто особливості цифрової трансформації, яка розуміється як процес кардинальної перебудови організації, управління, функцій та методів діяльності, інформаційної культури та інформаційної свідомості суб’єктів правовідносин за рахунок використання ними інформаційних технологій. З’ясовано, що постійні терористичні атаки Російської Федерації спричинили значні руйнування об’єктів інфраструктури України, які виступають необхідною технічною та технологічною базою цифрових трансформацій. Визначено, що формулювання принципів цифрової трансформації, узгоджених з чинними та перспективними acquis communautaire Європейського Союзу, видається нині надзвичайно важливим, оскільки зупинення руху у напрямі правового забезпечення досягнення цифрових цілей призведе до фатального відставання України у сфері цифрового розвитку. Акцентовано увагу на необхідності формулювання узгоджених з базовими правовими актами Європейського Союзу й органічно пов’язаних з українськими правовими цінностями принципів цифрової трансформації. На підставі аналізу актів європейського законодавства у сфері цифрової трансформації визначено, що досягнення поставлених перед Європейським Союзом і державами-членами цілей пов’язується із додержанням європейських демократичних цінностей та принципів. Такі цінності та принципи загалом узгоджуються з нормами українського законодавства і відображені у Конституції України, законах України «Про інформацію», «Про доступ до публічної інформації», «Про захист персональних даних», «Про електронні довірчі послуги», «Про Національну програму інформатизації» та інших. Обґрунтовано, що цифрова трансформація України має відбуватися з урахуванням векторів руху Європейського Союзу у напрямі побудови стійкого цифрового суспільства, заснованого на людиноцентризмі. Сформульовано сутність та охарактеризовано принципи солідарності, інклюзивності, вільного доступу до цифрових послуг, цифрової освіти, навчання та навичок, свободи вибору у разі взаємодії з алгоритмами та системами штучного інтелекту та безпеки цифрового середовища, які мають бути покладені в основу процесу цифрової трансформації нашої держави. The article discusses the features of digital transformation, understood as a process of fundamental restructuring of the organization, management, functions and methods of activity, information culture and information consciousness of the subjects of legal relations through the use of information technologies. It is emphasized that the constant terrorist attacks of the Russian Federation have led to signifcant destruction of Ukraine’s infrastructure facilities, which are the necessary technical and technological basis for digital transformations. The formulation of the principles of digital transformation, consistent with the current and prospective acquis communautaire of the European Union, is extremely important, since stopping the movement towards legal support for the achievement of digital goals will lead to a fatal lag in Ukraine in the feld of digital development. The necessity is proved by the formulation of the principles of digital transformation, coordinated with the basic legal acts of the European Union and organically related to Ukrainian legal values. Based on the analysis of European legislation acts in the feld of digital transformation, it was determined that the achievement of the goals set for the European Union and the Member States is linked to the observance of European democratic values and principles. Such values and principles are generally consistent with the norms of Ukrainian legislation and are reflected in the Constitution of Ukraine, the Laws of Ukraine “On Information”, “On Access to Public Information”, “On the Protection of Personal Data”, "”On Electronic Trust Services”, “On the National Program informatization” and others. The rationale is given that the digital transformation of Ukraine should take place taking into account the vectors of movement of the European Union in the direction of building a sustainable digital society based on humancentrism. The essence is formulated by the principles of solidarity, inclusiveness, free access to digital services, digital education, training and skills, freedom of choice when interacting with algorithms and systems of artifcial intelligence and security of the digital environment, which should be the basis of the process of digital transformation of our state.
