Особливості громадського контролю за діяльністю Національної поліції

Abstract

У науковій статті досліджено та розкрито особливості громадського контролю за діяльністю Національної поліції України. Вказано, що одним із ефективних способів управління державними справами є громадський контроль за діяльністю органів державної влади, зокрема Національної поліції. Зазначено, що громадський контроль за діяльністю Національної поліції виводить на новий рівень взаємодію між цими суб’єктами, що в свою чергу забезпечує ефективність роботи Національної поліції та довіру громадян до її посадових і службових осіб. Громадський контроль за діяльністю Національної поліції України є надзвичайно важливим та необхідним для розвитку правової, соціальної та демократичної держави. Також, проаналізовано основні нормативно-правові документи, які регулюють здійснення громадського контролю за діяльністю Національної поліції України. У статті розкрито організаційно-правові форми громадського контролю за діяльністю Національної поліції. Серед основних форм виділено представництво громадськості в колегіальних органах при центральних і територіальних підрозділах Національної поліції та участь громадськості в обговоренні та підготовці нормативно-правових актів, які регулюють діяльність Національної поліції, участь представників громадськості у відборі кандидатів в Національну поліцію та проходження атестації кадрів, а також громадський моніторинг. Як особлива форма громадського контролю громадський моніторинг є проявом реальної демократії та найбільш поширеною формою взаємодії громадськості з органами державної влади. На основі аналізу праць вчених визначено суб’єктів громадського контролю за діяльністю Національної поліції. Зокрема, за ознакою компетентності виділяють загальні, спеціальні та фахові (кваліфіковані) суб’єкти громадського контролю; суб’єкти спеціалізованого контролю та загальні суб’єкти контролю; організована та неорганізована громадськість; зацікавлені особи. У статті зазначено, що у зв’язку із запровадженням на території України дії воєнного стану Закон України «Про Національну поліцію» доповнено статтею 901 «Особливості громадського контролю за діяльністю поліції під час дії воєнного стану» де вказано, що під час дії воєнного стану громадський контроль за діяльністю поліції, визначений статтями 86-88 та статтею 90 цього Закону, не здійснюється. Peculiarities of public control over the activities of the National Police of Ukraine are investigated and revealed in the scientifc article. It is indicated that one of the effective ways of managing state affairs is public control over the activities of state authorities, in particular the National Police. It is noted that public control over the activities of the National Police brings the interaction between these subjects to a new level, which in turn ensures the effectiveness of the work of the National Police and the trust of citizens in its offcials and offcials. Public control over the activities of the National Police of Ukraine is extremely important and necessary for the development of a legal, social and democratic state. Also, the main regulatory and legal documents that regulate the implementation of public control over the activities of the National Police of Ukraine were analyzed. The article reveals the organizational and legal forms of public control over the activities of the National Police. Among the main forms, the representation of the public in the collegial bodies of the central and territorial units of the National Police and the participation of the public in the discussion and preparation of normative legal acts regulating the activities of the National Police, the participation of public representatives in the selection of candidates for the National Police and the passing of personnel certifcation, as well as public monitoring. As a special form of public control, public monitoring is a manifestation of real democracy and the most common form of public interaction with state authorities. Based on the analysis of the works of scientists, the subjects of public control over the activities of the National Police were determined. In particular, general, special and professional (qualifed) subjects of public control are distinguished based on competence; subjects of specialized control and general subjects of control; organized and unorganized public; interested persons. The article states that in connection with the introduction of martial law on the territory of Ukraine, the Law of Ukraine “On the National Police” was supplemented by Article 901 “Peculiarities of public control over police activities during martial law”, which states that during martial law, public control over police activities defned by Articles 86-88 and Article 90 of this Law is not carried out.
