Consequences of failure to comply with civil legal obligations during the war (Web of Science)

Abstract

У статті висвітлено особливості наслідків невиконання цивільно-правових зобов’язань під час воєнного стану, а також досліджено цивільно-правову відповідальність як один із наслідків порушення зобов'язання, структурні елементи цивільно-правової відповідальності, її роль у забезпеченні належного виконання зобов'язань, захисті цивільних прав і інтересів у сучасних умовах. Правові наслідки розглядаються у контексті невиконання та неналежного виконання зобов'язань. Зосереджено увагу на таких категоріях як відповідальність, збитки, з’ясовано відмінність між «непереборними» та «надзвичайними» обставинами. The article highlights the features of the consequences of non-fulfillment of civil obligations during martial law, as well as the study of civil liability as one of the consequences of breach of obligation, structural elements of civil liability, its role in ensuring proper implementation of obligations and protection of civil rights and interests in the civil law of Ukraine in modern conditions. The legal consequences of non-performance and improper performance of obligations are considered. Civil liability, damages, the distinction between “insurmountable” and “extraordinary” in civil law are studied.
