Abstract

Перспективною для усвідомлення сутності криптовалюти в контексті кримінально-правового регулювання вбачається систематизація її ознак і встановлення їх змісту. Видається, що найбільш вдалою систематизацією ознак криптовалюти буде традиційна для кримінально-правового регулювання система ознак предмета злочину: фізична, економічна, юридична. Фізична ознака характеризує технічні аспекти функціонування криптовалюти. Економічну ознаку визначає ціна, яку за неї можуть заплатити зацікавлені особи. Юридична ознака встановлюється на підставі послідовного аналізу передбачених чинним законодавством видів об’єктів цивільних прав. Отже, у контексті кримінально-правового регулювання криптовалюта представляє собою дані в електронному вигляді, що мають ціну та є предметом реалізації права на інформацію. Cryptocurrency, everything that happens to it, has become the top theme of world socio political and media discourses. The number of participants in social processes directly related to its functioning is constantly increasing and the growth of the volume of finances involved in this area is proportional. Naturally, there is a need for legal regulation. It is necessary to explore the possibility of applying the norms of the current legislation for regulation, in particular criminal legal, public relations in the sphere of the use of cryptocurrency. Perspective for understanding the essence of cryptocurrency in the context of criminal law is to systematize its features and establish their content. It turns out that the most successful systematization of characteristic features of cryptocurrency will be the traditional for criminal legal regulation of the characteristics of the subject of the crime: physical, economic, legal. The physical sign of cryptocurrency is that technically a cryptocurrency represents information about the state of a particular "electronic purse" of a given cryptocurrency system that is generated by cryptographic methods based on all previous transactions corresponds to actual transactions and is stored in sufficient numbers of system participants. The economic characteristic of cryptocurrency is determined by the price that it can be paid by interested persons. The key point here is that the value of the cryptocurrency is not secured and is determined situationally on the basis of demand and supply, the only body setting the rate to the national currencies is absent. Nevertheless, the useful properties of cryptocurrency (security, confidentiality, decentralization, almost instantaneous transfer to any part of the world) provide a stable demand for it.
