Теоретико-правові засади дослідження інформаційної безпеки

Abstract

У статті розглядається інформаційна безпека в контексті існуючих вітчизняних доктринальних досліджень на теоретичному та законодавчому рівнях в Україні. Вивчено різні наукові підходи до розуміння поняття «інформаційна безпека», запропоноване авторське визначення цієї категорії. Так, у теоретикоправових дослідженнях інформаційної безпеки доцільно її розглядати крізь призму правовідносин, що виникають при забезпеченні стану захищеності інформаційного простору. Підкреслюється, що пріоритетним має стати власне комплексне розуміння сутності та гарантій забезпечення інформаційної безпеки держави, враховуючи функціональні аспекти національної безпеки та специфіку інформаційної сфери, національного і світового інформаційного простору. The paper considers information security in Ukraine at the theoretical and legislative levels. Different scientific approaches to the understanding of “information security” are studied. The approach to disclosing the essence of information security through the wider concept of national security is widespread. In particular, it is used in encyclopedic and reference literature. In the multi-volume legal encyclopedia, Ukraine’s information security is defined as one of the types of national security, an important function of the state. The issue of independence of information security as an element in the system of national security is still debatable. For example, scientists V. Lipkan, E. Maksimenko, M. Zhelykhovsky state that national security is a holistic existential phenomenon, and therefore cannot be represented by a set of correlated components (economic, informational, political security, etc.). National security should be analyzed through the prism of its systemic qualities, so it is advisable to speak about national security in the information sphere, ecological, etc. After all, with the advent of other “constituent” national security as such will not change its essence. At the same time, when it comes to manifestations of national security in various spheres of life, the emergence of either new social relations, or spheres of life, will in no way affect the content of national security, only change it. Other scientists consider information security as a component, a subsystem, or an element of national security. The following approach, used in clarifying the content of the notion of information security, is based on determining the nature (static or dynamic) of this social phenomenon. If we consider information security in dynamics, then it can be defined as a process, certain activity, provision or application of measures. Attention should be drawn to another approach to the definition of “information security”, according to which it is considered through the prism of public relations. In scientific literature, such an approach is considered to be extraordinary and innovative, but in our opinion, it is he who allows revealing the legal nature of information security, to study its structure in detail. In our opinion, in theoretical and legal studies of information security it is expedient to consider it through the prism of legal relationships that arise when ensuring the state of security of information space. Thus, information security can be defined as legal relationships that arise in the implementation of preventive and protective measures in the information environment of people, society and the state.
