Тероризм: антропологічно-правовий аспект: автореферат

Abstract

Здійснено комплексне наукове дослідження тероризму шляхом заглиблення у його антропологічну складову, з урахуванням процесів глобалізації та встановлення нерозв’язаних сучасних суперечностей, які знаходяться в основі філософського осмислення цього явища. Встановлено зміст понятійного апарату тероризму як філософської категорії на основі вивчення стану дослідження теми, розкрито методологічну сутність тероризму в контексті антропології права. Досліджено правову природу та сутність небезпеки тероризму в його онтологічному вимірі, розкрито гносеологічний характер сучасного тероризму. З позиції філософії права досліджено антропологічний сутнісний характер тероризму у співвідношенні з філософсько-правовими категоріями «права людини», «справедливість», «насильство». Проаналізовано способи використання релігії у терористичних актах і критерії розмежування тероризму від боротьби за національний суверенітет. Розкрито суперечності тероризму і людини в концепті протистояння. Значну увагу приділено дослідженню актуальної на момент написання наукової роботи проблеми – тероризму як засобу та стратегії комунікації. Визначено основні напрями комунікативного впливу, які терористичні організації використовують у своїй діяльності, і технологію їх подолання в умовах сьогодення. Запропоновано теоретичні рекомендації у сфері боротьби з тероризмом.The dissertation provides a comprehensive scientific study of terrorism by immersion in his anthropological component, taking into account the processes of globalization and setting of unresolved modern contradictions underlying the philosophical understanding of this phenomenon. It is determined the content of conceptual apparatus «terrorism» as a philosophical category that based on the study of the research state of topics and it is considered methodological nature of terrorism in the context of anthropology of law. The legal nature and essence of the dangers of terrorism are researched in its ontological dimension, gnoseological nature of modern terrorism is disclosed. From the standpoint of legal philosophy it is researched anthropological essential nature of terrorism in relation to the philosophical and legal categories: «human rights», «justice» and «violence». The ways to use religion for terrorist acts and criteria terrorist differentiation between national sovereignty are analyzed. Contradiction of terrorism and human is disclosed in concept of confrontation. Special attention is paid to research actual problem at the time of writing terrorism as means and strategy of communication. It is determined the main directions of communicative influence that terrorist organizations are used in their work and the technology of its overcome in today's conditions. The theoretical guidelines in the field of control of terrorism have been proposed.
