Abstract

У дисертації комплексно на загальнотеоретичному та прикладному рівнях проаналізовано юридичну природу актів тлумачення норм права та окреслено можливості подальшого використання отриманих наукових результатів у правовій діяльності. Сформульовано методологічні засади дослідження теорії тлумачення норм права. Здійснено загальнотеоретичну характеристику тлумачення норм права. Проаналізовано зміст, ознаки, функції та структуру актів тлумачення норм права. Охарактеризовано види актів тлумачення норм права з виокремленням нових критеріїв класифікації. Досліджено процес оприлюднення ак тів тлумачення норм права. Виявлено особливості дії актів тлумачення норм права в часі, просторі та за колом осіб. Розкрито місце і роль актів тлумачення норм права у правовій діяльності та регулюванні суспільних відносин. Виокремлено та проаналізовано чинники, що зумовлюють необхідність актів тлумачення норм права в сучасній Українській державі. Висвітлено проблемні аспекти забезпечення ефективності актів тлумачення норм права. The legal nature of the acts of interpretation of rules of law is comprehensively analyzed at the general-theoretical and applied levels and possibilities for the further use of scientific results in the legal activity are outlined in the dissertation. The methodological principles of the theory research of the interpretation of rules of law are formulated. The general-theoretical characteristic of the interpretation of rules of law is carried out. The content, features and functions of acts of interpretation of rules of law are analyzed. The structure of acts of interpretation of rules of law is analyzed. The types of acts of interpretation of rules of law with new distinguished criteria for the classification are described. The procedure of promulgation of acts of interpretation of rules of law is studied. Operation peculiarities of acts of interpretation of rules of law in time, in space and a circle of people are revealed. The place and role of acts of interpretation of rules of law in the legal activity and the regulation of social relations are determined. Factors predetermining the necessity of acts of interpretation of rules of law in the modern Ukrainian State are outlined and analyzed. Problematic aspects of ensuring the effectiveness of acts of interpretation of rules of law are elucidated.
