Існування правового нігілізму як фактору порушення основоположних прав людини

Abstract

Розбудова України як правової та демократичної держави неможлива без подолання правового нігілізму населення. Позбутися цього явища можна завдяки підвищенню правової культури і правосвідомості громадян. Актуальність цієї теми спонукає дослідити явище правового нігілізму та знайти способи боротьби з ним задля розвитку України як правової та демократичної держави і забезпечити захист прав людини. Метою цього дослідження є проведення комплексного аналізу причин виникнення правового нігілізму для його викорінення із правового життя України. Результатами дослідження слід зазначити визначення основних понять і термінів; з’ясування рівня правового нігілізму населення України та дослідження історії становлення цього явища; проведення комплексного аналізу причин виникнення й існування правового нігілізму; встановлення рівня та причини існування правового нігілізму серед працівників правоохоронних органів; з’ясування негативних сторін правового нігілізму, зокрема у сфері захисту прав людини; аналіз впливу правової освіти на процес викорінення недовіри та зневаги до права; дослідження явища правового нігілізму в умовах повномасштабного вторгнення Російської Федерації в Україну. Також проаналізовано міжнародні дослідження і рекомендації щодо боротьби з правовим нігілізмом; вироблено механізми, які потрібно виконати для подолання правового нігілізму в державі. Для подолання явища правового нігілізму в Україні запропоновано − удосконалювати нормативно-правову базу, підвищувати правову культуру та правову освіту серед населення, проводити профілактичну роботу щодо перешкоджання та попередження вчинення правопорушень, забезпечувати правопорядок та законність у державі, боротися з корупцією, починаючи із внесення змін до законодавства, переймати досвід розвинутих країн світу щодо подолання корупції;, підвищувати роль населення у процесі ухвалення рішень. Також, вбачається за доцільне в подальших дослідженнях приділити більш детальну увагу правовій освіті населення, запровадженню реформ, які сприятимуть подоланню правового нігілізму, а також підвищать довіру до органів державної влади. The development of Ukraine as a legal and democratic state requires the entire population of Ukraine and state bodies to overcome the problems that arise before the state, in particular, to increase legal culture and legal awareness by overcoming the phenomenon of legal nihilism in the country. The relevance of this topic creates the need to conduct a study of the phenomenon of legal nihilism and develop ways to combat it for the sake of the development of Ukraine as a legal and democratic state, as well as the provision and protection of human rights. The purpose of this study is to carry out a comprehensive analysis of the causes of legal nihilism in order to eradicate it from the legal life of Ukraine. The results of the study are the definition of basic concepts and terms; clarifying the level of legal nihilism in Ukraine and researching the history of its formation; carrying out a comprehensive analysis of the causes of the emergence and existence of legal nihilism; establishing the level and reasons for the existence of legal nihilism among law enforcement officers; clarification of the negative aspects of the existence of legal nihilism, in particular in the field of human rights protection; analysis of the impact of legal education on the process of eradicating the phenomenon of mistrust and contempt for the law; study of the phenomenon of legal nihilism in the conditions of war; international studies and recommendations on combating legal nihilism were clarified and analyzed; developed a number of mechanisms that need to be implemented in order to overcome legal nihilism in the country. In order to overcome the phenomenon of legal nihilism in Ukraine, it is proposed to improve the regulatory and legal framework, increase legal culture and legal education among the population, carry out preventive work to prevent and prevent the commission of offenses, ensure law and order and legality in the state, fight corruption, starting with amendments to legislation, adopt the experience of the developed countries of the world in overcoming corruption; increase the role of the population in the decision-making process. Also, it is proposed to pay more detailed attention to the legal education of the population in further studies, to the implementation of a number of reforms in the country that will contribute to overcoming the phenomenon of legal nihilism, as well as to increasing trust in state authorities.
