Окремі аспекти методів примусового виконання рішень

Abstract

У статті проаналізовані методи примусового виконання юрисдикційних рішень як сукупність нормативно-визначених прийомів та способів впливу органів примусового виконання і осіб, що мають делеговані повноваження у сфері виконавчого провадження на сторін та учасників провадження, що здійснюються в межах їх компетенції з метою забезпечення своєчасного і повного виконання юрисдикційного рішення, а також дотримання законодавства про виконавче провадження. Акцентовано увагу на тому що методи примусового виконання забезпечують вплив на сторін виконавчого провадження, метою якого є вирішення питань організаційного значення та створення умов для повного і своєчасного виконання рішення. The article analyzes the methods of enforcement of jurisdictional decisions as a set of normatively defined methods and methods of influence of enforcement bodies and persons with delegated powers in the field of executive proceedings on the parties and participants in proceedings carried out within their competence in order to ensure timely and complete execution jurisdictional decision, as well as compliance with the legislation on executive proceedings. Attention is focused on the fact that enforcement methods provide influence on the parties to enforcement proceedings, the purpose of which is to resolve issues of organizational importance and create conditions for full and timely execution of the decision.
