Правове регулювання реабілітації в сфері охорони здоров’я

Abstract

У статті зазначається, що законодавство гарантує кожному право на охорону здоров’я та медичну допомогу. Повномасштабне вторгнення викликає необхідність опрацювання та оновлення нормативно-правових актів щодо забезпечення права особи на медичну допомогу, зокрема на надання реабілітаційних послуг. Зазначено, що реабілітаційна допомога спрямована на низку основних напрямків, по-перше, на підтримку функцій організму пацієнта в процесі загострення хронічних захворювань. По-друге – на попередження, ранню діагностику порушень роботи органів та систем організму пацієнта. Третій напрямок направлений на повне чи часткове відновлення порушених органів чи систем та компенсацію втрачених функцій уражених органів чи систем. Четвертий напрямок пов’язаний із попередженням та зниженням ступеня інвалідизації. Автор наголошує, що відсутність грамотної та ефективної медичної реабілітації в Україні – багатофакторна проблема: є недостатня кількість стаціонарних та амбулаторних відділень реабілітації; нестача медичного персоналу – реабілітологів, психологів; не вистачає реабілітаційного обладнання; існує потреба в належних освітніх програмах для лікарів. У статті автор наголошує, що одним з завдань держави є сприяння реалізації особами з інвалідністю їх конституційних прав; проведення державної політики у сфері реабілітації осіб з інвалідністю, підтримка їх інтеграції у суспільство, а повномасштабна війна на території України зумовлює все більшу актуальність та потребу реабілітації осіб, які постраждали внаслідок бойових дій. Такі чинники здоров’я наcелення, як зростання захворюваності, травматизм, тимчасова втрата працездатності, передчасна смертність населення вимагають розвитку ринку реабілітаційної медицини України та його правового регулювання. У статті зазначається, що позитивними аспектами є розробка нових технологій медичної реабілітації, у тому числі на основі телемедицини та IT-технологій, підготовка нових професійних стандартів для медичної реабілітації на сучасному рівні відповідно до міжнародних рекомендацій. Все це вимагає ефективного функціонування системи, що насамперед потребує удосконалення та розвитку нормативно-правового забезпечення у сфері реабілітації. The article notes that the law guarantees everyone the right to health care and medical assistance. A full-scale invasion calls for the development and updating of legal acts on ensuring a person’s right to medical assistance, in particular, to the provision of rehabilitation services. It is noted that rehabilitation assistance is aimed at a number of main areas, frstly, at supporting the functions of the patient’s body during the exacerbation of chronic diseases. Secondly, for warning, early diagnosis of disorders of the organs and systems of the patient’s body. The third direction is aimed at full or partial restoration of damaged organs or systems and compensation of lost functions of affected organs or systems. The fourth direction is related to the prevention and reduction of the degree of disability. The author emphasizes that the lack of competent and effective medical rehabilitation in Ukraine is a multifactorial problem: there is an insufcient number of inpatient and outpatient rehabilitation departments; lack of medical personnel - rehabilitation specialists, psychologists; there is not enough rehabilitation equipment; there is a need for adequate educational programs for physicians. In the article, the author emphasizes that one of the tasks of the state is to help persons with disabilities realize their constitutional rights; implementation of state policy in the feld of rehabilitation of persons with disabilities, support for their integration into society, and the full-scale war on the territory of Ukraine causes an increasing urgency and need for the rehabilitation of persons injured as a result of hostilities. Such factors of the population’s health, such as the increase in morbidity, injuries, temporary loss of working capacity, premature mortality of the population require the development of the rehabilitation medicine market of Ukraine and its legal regulation. The article notes that the positive aspects are the development of new medical rehabilitation technologies, including those based on telemedicine and IT technologies, the preparation of new professional standards for medical rehabilitation at the modern level in accordance with international recommendations. All this requires the effective functioning of the system, which frst of all requires the improvement and development of regulatory and legal support in the feld of rehabilitation.
