Ethno-national policies: legal dimensions and protections for indigenous peoples (Web of Scince)

Abstract

Проблема дотримання прав корінних народів є актуальним викликом для сучасної правової системи. Метою даного дослідження є вивчення правових аспектів етнонаціональної політики, особливо щодо захисту прав та інтересів корінних народів. Дослідження базується на наукових методах узагальнення, аналізі чинних нормативних документів та наукової літератури. Проведено аналіз наукової літератури за критеріями відбору відповідних досліджень та їх обробки. Отримані результати свідчать, що термін «етнонаціональна політика» визначає комплекс державних заходів, спрямованих на задоволення потреб етнічних та корінних спільнот у межах національної держави. Відзначається, що траєкторія розвитку суспільства обмежила захист прав корінних народів. Важливим кроком у протидії цьому стало прийняття Міжнародною організацією праці Конвенції № 169, яка визначила підходи до захисту та інтеграції прав корінних народів. Автори зазначають, що ця Конвенція, як і Декларація прав корінних народів, сприяли покращенню їх правового захисту та соціального статусу, хоча деякі країни ЄС не прийняли положення Конвенції. Зазначається, що право на самовизначення доповнює інші права, зокрема право на культуру та автономію. Декларація визнає зв'язок між самовизначенням, автономією та збереженням самобутності корінного населення. У висновках наголошується на регіональних ініціативах і судовій практиці, включаючи рішення Міжамериканського суду з прав людини, які підтверджують права корінних народів на землю та ресурси. Te problem of observance of the rights of indigenous peoples is an urgent challenge for the modern legal system. Te purpose of this study is to examine the legal aspects of ethnonational policy, especially in protecting indigenous peoples’ rights and interests. Te study is based on the scientifc methods of synthesis, analysis of current regulations, and scientifc literature. Te scientifc literature analysis was carried out per the criteria for selecting relevant studies and their processing. Te results show that the term “ethno-national policy” defnes a set of governmental measures aimed at addressing the needs of ethnic and indigenous communities within the nation-state. It is observed that the trajectory of society’s development has limited the protection of the rights of indigenous peoples. An important step in counteracting this was the adoption of Convention No. 169 by the International Labour Organization, which defned approaches to the protection and integration of the rights of indigenous peoples. Te author notes that this Convention, as well as the Declaration of the Rights of Indigenous Peoples, have contributed to improving their legal protection and social status, although some EU countries have not adopted the provisions of the Convention. It is noted that the right to self-determination flls other rights, including the right to culture and autonomy. Te Declaration recognises the link between self-determination, autonomy, and the preservation of indigenous identity. Te conclusions emphasise regional initiatives and jurisprudence, including decisions of the Inter-American Court of Human Rights, which confrm indigenous peoples’ rights to land and resources. O problema da observância dos direitos dos povos indígenas é um desafo urgente para o sistema jurídico moderno. O objetivo deste estudo é analisar os aspectos jurídicos da política etno-nacional, especialmente no respeito à proteção dos direitos e interesses dos povos indígenas. O estudo baseia-se nos métodos científcos de síntese, de análise da regulamentação em vigor literatura científca. A análise da literatura científca foi efectuada de acordo com os critérios de seleção dos estudos pertinentes e do seu tratamento. Os resultados mostram termo “política etno-nacional” defne um conjunto de medidas governamentais destinadas a responder às necessidades das comunidades étnicas e indígenas no âmbito do Estadonação. Observa-se que a trajetória de desenvolvimento da sociedade tem limitado a proteção dos direitos dos povos indígenas. Um passo importante para contrariar esta situação foi a adoção da Convenção n.º 169 pela Organização Internacional do Trabalho, que defniu abordagens para a proteção e integração dos direitos dos povos indígenas. O autor observa Convenção, bem como a Declaração dos Direitos dos Povos Indígenas, contribuíram para melhorar a sua proteção jurídica e estatuto social, embora alguns países da UE não tenham adotado as disposições da Convenção. É de notar direito à autodeterminação preenche outros direitos, incluindo o direito à cultura autonomia. A Declaração reconhece a ligação entre a autodeterminação, a autonomia preservação da identidade indígena. As conclusões sublinham as iniciativas e a jurisprudência regionais, incluindo as decisões do Tribunal Interamericano dos Direitos do Homem, que confrmam os direitos dos povos indígenas à terra e aos recursos.
