Перешкоджання діяльності у кримінальному праві України: автореферат

Abstract

Комплексно проаналізовано проблеми перешкоджання діяльності у кримінальному праві України. На підставі цього сформульовано пропозиції щодо вдосконалення чинного законодавства в частині встановлення кримінальної відповідальності за злочини, пов’язані з перешкоджанням різним видам діяльності. Визначено поняття та класифікацію злочинів, що полягають у перешкоджанні діяльності, за кримінальним законодавством України. З’ясовано питання про принципи та передумови криміналізації при встановленні кримінальної відповідальності за перешкоджання діяльності. Висвітлено зарубіжний досвід встановлення кримінальної відповідальності за перешкоджання діяльності, описано історичний розвиток законодавчої регламентації відповідальності за таке діяння. Охарактеризовано об’єктивні та суб’єктивні ознаки складів злочинів, що передбачають відповідальність за перешкоджання діяльності. Розглянуто санкції статей, у яких передбачена відповідальність за перешкоджання діяльності, та практику призначення покарання за такі злочини. З’ясовано особливості звільнення від кримінальної відповідальності та покарання за перешкоджання діяльності. З-поміж іншого доведено необхідність уніфікації законодавчого визначення ознак складів злочинів, що полягають у перешкоджанні діяльності (вказівки на законність/незаконність певних дій, форму вини тощо), обґрунтовано доцільність внесення змін до санкцій статей (частин статей), які передбачають відповідальність за перешкоджання діяльності, з метою увідповіднення їх із правилами побудови кримінально-правових санкцій.In the dissertation comprehensively analyzed problems of obstruction of activities in the criminal law of Ukraine, under which formulated proposals to improve existing legislation and imposing criminal liability for crimes associated with obstruction various activities. Identified the concept and classification of crimes, that obstruction of activites by criminal legislation of Ukraine. Studied the consideration of principles of criminalization in establishing criminal responsibility for obstruction of activities. An international experience of installation criminal responsibility for obstruction of activities and historical development legislative regulation of responsibility for that act were analyzed. In this work characterized objective and subjective elements of crime, which providing the liability for obstruction of activities. The sanctions articles, in which provides the liability for obstruction activities and the practice of sentencing for such crimes were considered. Identified the features exemption from criminal responsibility and punishment for obstruction of activities. The conception of crimes in obstruction of activites in the broadest sense (as crimes, which directly impinge on the right to exercise legal activity) and narrow (as crimes objectively limited side, which act in the form of obstruction of business) were offered. Installed that obstruction of activites can not be an aim or purpose or result of the offense, therefore instructions in the text of the Criminal Code of Ukraine on the proper aim or results were suggested to exclude or replace obstruction of view. Justified that species subject crimes in obstruction of activites is the right of the subject to exercise activity, which is not prohibited by law; the obstruction of activites as a features of objective side corresponding forms of crime – is the activity in the form of obstruction (obstacle) to the right of another person to an activity not prohibited by law. Proved the necessity of unification legal definition of elements of crimes in obstruction of activites (instructions on legality / illegality of certain acts, the form of guilt, etc.), soundly the expediency of amending the sanctions articles (parts of the articles) to providing for liability for obstruction of activities in order to bring them into line with the rules of constructing criminal sanctions. Offered to determine an objective aspect of the crime, which provided for in paragraph 1 of Article 114-1 CC Ukraine as impeding the activity of the Armed Forces of Ukraine or other military formation, directly linked to national security of Ukraine.Proved that an open list of ways to obstruct journalistic activities is inappropriate and should be replaced by pointing out at the activity – illegal obstruction of journalistic activities; influence in different forms to the journalist in order to prevent his professional obligations (Part 2 of Article 171 CC of Ukraine) is nothing else as obstruction such activities and, therefore, these provisions of paragraph 2 of Article 171 of the CC of Ukraine duplicated provisions of Part 1 of that article and should be excluded from the text of Article 171 of the CC of Ukraine; Determines that the title of the article 171 of the CC of Ukraine does not comply with its content, because in addition to responsibility for obstruction professional activities of a journalist, it contains provisions on the responsibility for the persecution of journalists, therefore, proposed to put it this way: «Interference with the professional activities of a journalist or persecution him in connection with this activities»
