Кримінально-правова охорона таємниці в Україні: автореферат

Abstract

Дисертація є комплексним дослідженням охорони таємниці. У роботі проаналізовано стан дослідження питання кримінально-правової охорони таємниці та розвиток нормативного закріплення охорони таємниці в пам’ятках вітчизняного кримінального права. Порівняно охорону таємниці в кримінальних законах України та окремих зарубіжних держав. Узагальнено систему норм та наведено загальну характеристику типових посягань на таємницю. Сформульовано дефініцію вказаного поняття та визначено його істотні ознаки. Розглянуто класифікацію таємниць, що охороняються нормами кримінального права.The dissertation is a comprehensive research on secrecy. The article analyzes the state study of the issue of criminal-legal secrecy and the development of 18 normative securing of secrecy in the monuments of domestic criminal law. A comparative analysis of regulatory regulation of secrecy in the criminal laws of Ukraine and certain foreign countries was carried out. The system of norms is generalized and the general characteristic of typical encroachments on the secret is given. Definition of the mentioned concept is formulated and its essential features are determined. The classification of secrets protected by the norms of criminal law is considered. Proposed changes to the Criminal Code of Ukraine related to the protection of secrecy.
