| Abstract: | Дисертацію присвячено типологізації та ідентифікації сучасних націо-нальних і міждержавних правових систем завдяки юридичним критеріям, індикації їхніх основних типів (підтипів і груп) для з’ясування реального стану їх функціонування та перспектив розвитку. Для цього в роботі уточнено пізнавальні можливості відповідних положень теорії типологізації для виокремлення основних типів сучасних правових систем; виявлено співвідношення поняття типологізації із суміжними поняттями; з’ясовано переваги типологізації над класифікацією в контексті дослідження сучасних правових систем світу. Обґрунтовано пізнавальний потенціал теорії правової системи з огляду на глобалізаційні виклики, а також з’ясовано пізнавальні можливості структурних частин правової системи (інституційної, функційної та нормативної) для формування юридичних критеріїв типологізації сучасних правових систем світу. Створено пізнавальну модель (юридичну конструкцію) «ідентифікаційний код правової системи» та на основі виявлених ознак визначено поняття ідентифікаційного коду правової системи як сукупності найсуттєвіших ознак інституційної, функційної та нормативної частин правової системи. Створено пізнавальну модель (юридичну конструкцію) «індикатор функціонування і розвитку правової системи»; сформульовано визначення по-няття індикатора функціонування і розвитку правової системи як системи показників реального стану функціонування та перспектив розвитку правової системи. Виокремлено індикатори функціонування і розвитку національних та міждержавних правових систем; індикатор взаємодії національних і міждер-жавних правових систем, а також встановлено показники (типові, допустимих відхилень, прогресивного і регресивного стану) цих індикаторів. Запропоновано та застосовано методику дослідження сучасних національ-них і міждержавних правових систем, їх типологізації, ідентифікації та індика-ції. У межах континентального типу виокремлено три групи правових систем, здійснено їх ідентифікацію та індикацію, а також виявлено основні проблеми їхнього функціонування і розвитку. Здійснено ідентифікацію правової системи України з континентальним типом, проведено її індикацію та запропоновано способи і засоби розв’язання проблем функціонування та розвитку. Здійснено ідентифікацію правових систем загального типу, проведено їх індикацію та виявлено основні проблеми їхнього функціонування і розвитку. Здійснено ідентифікацію правових систем змішаного типу, проведено їх індикацію та виявлено основні проблеми функціонування і розвитку. Здійснено іденти-фікацію міждержавних (універсальної та регіональних) правових систем, проведено їх індикацію; запропоновано способи і засоби розв’язання основних проблем їхнього функціонування та розвитку. Обґрунтовано природний характер національних правових систем та штучний характер міждержавних правових систем, які створені задля структурування геополітичного простору, забезпечення взаємодії національних правових систем, а також національних і міждержавних правових систем. The dissertation is devoted to the typologization and identification of contem-porary national and interstate legal systems based on legal criteria, as well as the indicator-based assessment of their primary types (subtypes and groups) to determine their actual operational state and developmental prospects. The study clarifies the explanatory power of relevant typologization theory provisions for delineating the main types of contemporary legal systems in the context of geopolitical changes; it establishes the relationship between the concept of typologization and related concepts, and elucidates the advantages of typologization over classification, given the latter's limited explanatory power in studying contemporary global legal systems. The explanatory power of legal system theory is substantiated in light of globalization challenges, and the explanatory power of the structural components of the legal system (institutional, functional, and normative) for formulating legal criteria to typologize contemporary global legal systems are determined. An explanatory model (legal construct) termed the "identification code of a legal system" is developed, and based on the identified characteristics, this code is defined as the aggregate of the most essential features comprising its institutional, functional, and normative components. The study develops an explanatory model (legal construct) of the "indicator of the functioning and development of a legal system"; and formulates the definition of this indicator as a system of metrics reflecting its actual operational state and developmental prospects. Typical metrics include: principles of the legal system's functioning, the range of subjects and their authorities, main types of legal activities, legal acts as the outcomes of these activities, and the ultimate goal of the legal system—the legal order. Metrics for permissible deviations, as well as progressive and regressive states, are isolated. Within the framework of species characteristics, indicators for the functioning and development of national and interstate legal systems are identified, along with an indicator of their interaction (which allows for ascertaining the operational and developmental state of national and interstate legal systems within a shared legal space). A methodology for researching, typologizing, identifying, and conducting indicator-based assessment of contemporary national and interstate legal systems is proposed and applied to uncover the fundamental regularities of legal polyvariance amidst geopolitical changes, to form legal means of interaction, and to devise methods for resolving identified problems. Typical metrics, metrics of permissible deviations, and metrics of progressive and regressive states are established for three groups of legal systems delineated within the continental law type: 1) legal systems with stable metrics and the effective use of legal form; 2) legal systems exhibiting stable metrics since the late 20th century, ensuring functional and developmental stability through legal form, and showing a tendency to converge with the first group; 3) legal systems (identified in the context of recent geopolitical events) with significantly deformed typical metrics; these are characterized by tendencies toward losing their legal form, which may indicate the legal system's degeneration into pseudo-legal form. The legal system of Ukraine is identified as belonging to the continental law type; its proximity to the second group of legal systems within this type is noted. It is established that its typical metrics generally correspond to the explanatory model, while simultaneously identifying problems in the functionning and development of Ukraine's legal system and proposing methods and means for their resolution. Typical metrics, metrics of permissible deviations, and metrics of progressive and regressive states are established for common law legal systems (English and American law). Typical metrics, metrics of permissible deviations, and metrics of progressive and regressive states are determined in the identified subtypes of the mixed type of legal systems (dualistic, religious, traditional, and customary). Two subtypes of interstate legal systems, universal and regional, are distinguished; it is established that the typical metrics of the UN legal system generally align with the explanatory model, metrics of permissible deviations are observed, metrics of a progressive state are practically absent, whereas a number of regressive state metrics are recorded. Within the regional subtype of interstate legal systems, the European, American, Asian, Arab, and African variants are analyzed; in some of these, not even typical metrics are recorded, yet tendencies toward progressive or regressive developmental states are observed. The state of interaction between national and interstate legal systems is determined; a significant convergence of national legal systems within interstate legal systems, the assimilation of their structural organization, as well as tendencies toward legal unification and the implementation of fundamental legal standards of regional interstate legal systems into national legal systems are noted. The natural character of national legal systems is substantiated in contrast to the artificial nature of interstate legal systems, which are established to structure the geopolitical space and facilitate interaction among national legal systems, as well as between national and interstate legal systems. |
