Короткий огляд (реферат): Досліджено підстави для ухвалення рішення про об’єднання матеріалів кримінального провадження. Розглянуто передбачені ч. 1 ст. 217 КПК України три підстави, за яких виникає необхідність в об’єднанні матеріалів кримінального провадження, а саме: 1) щодо декількох осіб, підозрюваних у вчиненні одного кримінального правопорушення; 2) щодо однієї особи, підозрюваної у вчиненні кількох кримінальних правопорушень; 3) матеріали досудових розслідувань, у яких не встановлено підозрюваних, проте є достатні підстави вважати, що кримінальні правопорушення, щодо яких здійснюються ці розслідування, вчинені однією особою (особами). Пояснено, у чому полягає потреба в ухваленні рішення про об’єднання матеріалів кримінального провадження за наведеними підставами. The grounds for making the decision about the amalgamation of the materials in criminal proceedings were researched. Three reasons that are foreseen by the part 1 of the article 217 of Code of Criminal Procedure and highlight the necessity to amalgamate the materials in criminal proceedings were studied. The amalgamation of the materials in criminal proceedings is done 1) in case of a number of persons being suspected of committing the same crime; 2) in case of one person being suspected of committing a number of crimes; 3) in case pretrial investigation materials do not talk about any suspects but contain a sufficient number of evidence to assume that criminal proceedings, which are investigated, were committed by one (or more) person(s). Based on the above grounds, the necessity to make the decision about the amalgamation of the materials in criminal proceedings is described. It is proven that if possible proceedings against accomplices should be instituted in one criminal case. This will allow not only to decrease procedural costs, but also to provide the proper criminal and legal assessment of committed crime. Based on the analysis of the regulations of the Criminal Procedure law of Ukraine as well as the practical experience of making the decision about the amalgamation of the materials in criminal proceedings the conclusion is drawn that the investigation and examination of all crimes committed by one person within one proceeding should be abided by the general rule since this will allow a proper assessment of social danger of this person and to avoid duplication of investigative and other procedural actions. The feasibility of the amalgamation of materials in pretrial investigation without a suspect but with reasonable grounds to believe that criminal offenses that are investigated are committed by one (or more) person(s) is proven. It is asserted that the amalgamation of the proceedings of unsolved cases could provide additional possibilities to determine person who committed these crimes, to expand the evidence base, and to identify patterns of committed crimes.
