Динаміка переосмислення правових і моральних цінностей у контексті цифрових трансформацій

Abstract

У статті здійснено комплексний міждисциплінарний аналіз динаміки переосмислення правових і моральних цінностей у контексті цифрових трансформацій сучасного суспільства. Досліджено соціально філософські та правові наслідки впровадження алгоритмічних систем, штучного інтелекту, великих даних, VR/AR-середовищ і цифрових платформ як нових чинників нормативного регулювання соціальної поведінки. Обґрунтовано тезу про трансформацію алгоритму в автономний регулятор, що функціонує паралельно до традиційних механізмів права і моралі та часто вступає з ними у ціннісний конфлікт. На основі показників цифрової активності населення України станом на 2025 рік проаналізовано вплив цифрового середовища на модифікацію поведінкових норм, соціальних практик і ціннісних орієнтацій гро мадян. Виявлено системні суперечності між формально правомірними алгоритмічними практиками та моральними оцінками суспільства, зокрема у сферах модерації контенту, обробки персональних даних, автоматизованого ухвалення рішень і соціального скорингу. Особливу увагу приділено цифровізації кримінального процесу, використанню електронних доказів та алгоритмічного аналізу даних як чинникам трансформації уявлень про справедливість, відповідальність і презумпцію невинуватості. Розкрито правові й етичні проблеми VR/AR-середовищ, пов’язані з цифровим насильством, симуляцією шкоди та розмиванням меж юридичної відповідальності. Запропоновано напрями гармонізації правових і моральних норм у цифрову епоху на засадах людиноцен тризму, алгоритмічної прозорості, етичного дизайну, підзвітності цифрових систем і інтеграції етичних принципів у правове регулювання. Доведено, що ефективне правове реагування на цифрові виклики потребує міждисциплінарної координації правових, етичних і технологічних підходів. Наголошено на необхідності адаптації національних правових систем до алгоритмічного регулювання з урахуванням міжнародних стандартів цифрової етики та прав людини. The article provides a comprehensive interdisciplinary analysis of the dynamics of rethinking legal and moral values in the context of digital transformations in modern society. It examines the socio-philosophical and legal consequences of the introduction of algorithmic systems, artificial intelligence, big data, VR/AR environments, and digital platforms as new factors in the normative regulation of social behavior. The thesis about the transformation of the algorithm into an autonomous regulator that functions in parallel with traditional mechanisms of law and morality and often enters into a value conflict with them is substantiated. Based on indicators of the digital activity of the Ukrainian population as of 2025, the influence of the digital environment on the modification of behavioral norms, social practices, and value orientations of citizens is analyzed. Systemic contradictions between formally legitimate algorithmic practices and moral assessments of society have been identified, particularly in the areas of content moderation, personal data processing, automated decision making, and social scoring. Particular attention is paid to the digitization of criminal proceedings, the use of electronic evidence, and algorithmic data analysis as factors transforming perceptions of justice, responsibility, and the presumption of innocence. The legal and ethical problems of VR/AR environments related to digital violence, simulation of harm, and blurring of the boundaries of legal responsibility are revealed. Directions for harmonizing legal and moral norms in the digital age are proposed, based on human-centeredness, algorithmic transparency, ethical design, accountability of digital systems, and the integration of ethical principles into legal regulation. It is proven that an effective legal response to digital challenges requires interdisciplinary coordination of legal, ethical, and technological approaches. The need to adapt national legal systems to algorithmic regulation, taking into account international standards of digital ethics and human rights, is emphasized.
